Interpreter for a Notarial Transaction
The process of completing any notarial transaction is often complicated when one of the parties involved is a foreign citizen. If they have limited or no proficiency in the Russian language, an interpreter must be present during the signing. The notary is obligated to ensure that the foreign national fully understands the meaning of the transaction being concluded and the text of the document being signed. Typically, all documents requiring signatures should be duplicated in the languages of both parties. For example, when concluding a prenuptial agreement between a Russian citizen and a German citizen, the agreement to be signed must be in both Russian and German. The larger the transaction and the more significant its consequences, the more strictly these requirements must be adhered to. Otherwise, there is a risk that the transaction could be contested.
The interpreter translates absolutely everything discussed during the signing to the foreign national, including the notary's explanations and the statements of the other party. Furthermore, the interpreter acts as a guarantor that the foreign citizen fully comprehends the meaning of what is happening. The signed document will bear the signatures of both parties, the notary, and the interpreter.
Who Can Act as an Interpreter?
The notary is legally responsible for the proper execution of the transactions they certify. Therefore, any interpreter is not suitable for this situation; it must be a qualified specialist with a degree in the relevant field. It is highly desirable that they have prior relevant experience. In such cases, there will be no issues with approving the interpreter's candidacy.
For interpretation at an event, such as negotiations, an exhibition, etc., it is not mandatory for the interpreter to have a degree in translation (linguistics or philology). In such cases, experience in interpreting for the specific specialization of the event is more important. However, for a notarial transaction, only a certified specialist is required.
The interpreter, like the notary, observes the confidentiality of the transaction. During the meeting, if necessary, they may sign relevant documents. Therefore, there is no need to worry about details of the notarized act becoming known to unauthorized individuals.
